AET Terms of Use

These license and usage terms are an agreement between Hanagriff, Ewell, Murphy, Inc. (“HEM”) and you, regarding you use of the Agricultural Experience Tracker (“AET”). Please read them. By subscribing to the AET or by signing onto the website
www.theAET.com, you accept them. If you do not accept any part of them, do not use the website. Instead, contact AET at
info@theaet.com for a refund or credit.
1. SUBSCRIPTION – The services provided at
www.theAET.com are provided to Ag Programs who pay a yearly subscription fee. The subscription includes: Ag Program access to the Chapter AET, permission to create student accounts for all students within the Ag Program, and student access to those Student AET accounts. Subscriptions expire on October 15 of each year. An Ag Program must re-subscribe each year to continue to have access to
www.theAET.com. HEM reserves the right to refuse subscriptions to any Ag Program.
2. SUBSCRIPTION PAYMENT – The cost of an AET subscription is set by HEM annually. The cost varies depending on the size of the Ag Program. To see a quote for the current year’s subscription, go to

info@thaet.com. Subscriptions are billed through the
www.JudgingCard.com system. After subscribing, you should sign in to
www.JudgingCard.com to see your invoice. Please submit the invoice to your school's billing office; you will not necessarily receive an invoice by mail. Payments are due in a timely manner. You can pay securely by credit card at
www.JudgingCard.com, or you can make a check payable to "Clay Ewell Educational Services" and mail it to: Clay Ewell Educational Services / PO Box 15924 / College Station, TX 77841-5125. Questions about your subscription may be emailed to
info@theaet.com. Subscriptions are non-refundable unless prior arrangements have been made with HEM.
3. MINIMUM COMPUTER REQUIREMENTS – To use the AET, you must have access to a computer with a reliable, high-speed connection to the Internet. The AET has been fully tested with Windows-based computers running Internet Explorer 7.0, although other platforms and browsers should be sufficient. Displays should be capable of at least 1024x768 resolution. Microsoft Excel 2000 or newer is required to edit most FFA award and degree applications. Applications may be viewed in the free Excel Viewer available from Microsoft.
4. SECURITY – Data is maintained on redundant networked servers, and HEM safeguards this information with firewalls, passwords, backups, and other software that follows industry standards for maintaining data security and reliability. Your information in the AET is secured with usernames and passwords. YOU AGREE NEVER TO PROVIDE YOUR PASSWORD TO ANYONE AND TO NOTIFY HEM IMMEADIATELY IF YOUR PASSWORD HAS BEEN LOST OR STOLEN. When you are finished using the website, you should always “Sign Out” and close your Internet Browser. Inactive sessions will automatically “sign out” after 20-30 minutes. Ag Programs and Students should safeguard their passwords to prevent unauthorized access. Passwords should be changed periodically. Within the AET’s databases, passwords are encrypted with a one-way algorithm; nobody can “view” your password. The AET website and AET support staff will never ask for personal information such as bank account numbers, credit card numbers, passwords, and social security numbers.
5. PRIVACY AND RELEASE OF INFORMATION – HEM understands that the protection and security of account information, and any other information that is personally identifiable, is of utmost importance. Students should be aware that Chapter AET automatically have complete access to Student Accounts. Most Regional AET accounts have access to Chapter and Student accounts within that region. Data within a Student’s AET account is available in Chapter reports at various degrees of aggregation and anonymity. For support purposes, AET Support personnel have complete access to Chapter and Student AET accounts. Personally identifiable information will never be sold or given to any third party. All data entered into Student and Chapter AETs is available to HEM for research purposes, usually for the improvement and promotion of the AET or the promotion of Agricultural Education in general. HEM follows standard research protocols to protect the anonymity of individual users.
6. SUBMITTED INFORMATION. The AET contains features that allow account holders to upload digital files. You agree not to submit to the Site any information that infringes upon or violates the privacy, rights, trademarks, copyrights or other intellectual property rights of others, anything that is illegal, defamatory, obscene, harassing, offensive, objectionable or sexually explicit, that encourages a violation of the law, that contains a virus, that is off-topic, or, without explicit written permission, that contains any solicitation or advertising. You agree to indemnify, defend and hold harmless HEM and its officers, directors, employees, shareholders agents and assigns from any damages and costs, including without limitation court costs and attorneys' fees, arising from your use of the Site. By submitting information to the Site, you grant HEM the royalty-free, perpetual, irrevocable, non-exclusive right to use, edit, copy, modify, adapt, combine, incorporate, publish, publicly perform, translate and distribute all or part thereof in any form and for any purpose whatsoever, and you also permit other users of the Site to use that information subject to the rules of the Site. AET personnel shall have the right, but not be obligated to, monitor the Site to determine users' compliance with this Agreement and applicable laws. HEM has the right in its sole discretion to not publish or remove any submitted information
7. DISCLAIMER, RELEASE OF LIABILITY, AND INDEMNITY – ALL CONTENT IS PROVIDED "AS IS" AND ANY AND ALL WARRANTIES ARE DISCLAIMED, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. The use of our information, products and services should be based on your own due diligence and you agree that we are not engaged in any professional service such as providing legal advice or accounting services. HEM makes an honest effort to ensure the accuracy of information, reports, and applications within
www.theAET.com. Users of
www.theAET.com agree to release HEM from all liability resulting from errors in this information. Users hold sole liability for the results of their FFA Award/Degree applications and users are encouraged to double-check these applications thoroughly before submission. Users agree not to sue or pursue other legal action against HEM (or any related party) for any reason. All disagreements must be settled out-of-court, and resolutions may rely on a non-biased third-party representative from the State FFA Association. Our cumulative liability to you or anyone else for any loss or damages resulting from any claims, demands, or actions arising out of or relating to this Agreement or use of the content or website shall not exceed the amount you have paid to us for the product or service. In no event shall we be liable for any indirect, incidental, consequential, special, or exemplary damages or lost profits, even if we have been advised of the possibility of such damages. You agree that the foregoing constitutes your sole and exclusive remedy for any breach of this Agreement. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
8. MISCELLANEOUS. This is the exclusive and entire Agreement between HEM, Inc. and you regarding its subject matter. You may not assign any part of this Agreement without HEM's prior written consent. This Agreement shall be governed by the laws of Texas without reference to choice of law principles. HEM may terminate or restrict your use of the Site at any time without notice if HEM believes you have not fully complied with this Agreement. Further, either party may terminate this Agreement at any time without cause; upon termination for any reason, all of your obligations under this Agreement shall continue, except that you agree to no longer access or use the Site. You consent to exclusive jurisdiction and venue in the courts of Texas for all matters arising out of or related to this Agreement or the Site. You understand that HEM may comply with law enforcement requests or subpoenas regarding your use of the Site. HEM reserves the right to modify the terms of this Agreement at any time by posting the new terms on the Site, which modifications shall take place immediately. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any prior or subsequent breach or default. If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement shall remain in effect and the invalid or unenforceable provision shall be replaced by a valid, enforceable provision that effectuates the intent of the original provision. HEM's suppliers, licensors, affiliates, subsidiaries, employees and agents shall be third party beneficiaries of HEM's rights under this Agreement. All rights not granted expressly by this Agreement are reserved by HEM Inc.
